2-Definitions
“Content” has the meaning set forth in Article 5.
“Service” or “Services” refers to the services provided to the User by Moment Care via the Site.
“Site” refers to the website published by Moment Care and accessible at: www.momentcare.fr
“User” refers to any individual accessing the Site.
3-Acceptance and modification of conditions of use
By accessing and using the Services, you acknowledge that you have read, understood and accepted these Terms of Use.
Moment Care reserves the right to modify and update these Terms of Use at any time without notice to the User.
4-Conditions of access to the site
Access to the Site is reserved for passengers of companies duly authorized by Moment Care to offer the Services as part of their offer.
Moment Care is committed to doing its utmost to classify content according to its appropriateness to the audience in terms of issues such as sex, violence, substance abuse, profanity, impudence or other types of mature content. Age rankings and recommendations are advisory only. Moment Care cannot guarantee that these will be available at all times or that the user will be able to access them without error. Similarly, Moment Care makes no warranty as to the suitability of the content included in its Services. In all cases, it is the Users’ responsibility to ensure that the age restrictions associated with the Content available on the Site are not violated.
Moment Care declines all responsibility in the event of non-compliance with the above conditions of access.
5-User obligations

Moment Care grants you a limited, personal, non-transferable, non-assignable, revocable, non-exclusive, non-sublicensable right to do the following:
distribute or download content: films, television series, games, e-press, music, trailers, images, works of art and other items protected by copyright (the “Content”) that are accessible to you from the Moment Care Service; and use the Moment Care site.
This is a user agreement and not an agreement to sell or assign rights to Moment Care content or services. The right to distribute or download any Moment Care content does not create any ownership right in the distributed content.
Restrictions on your use of content. You can’t and agree not to:
circumvent or disable any content protection system or digital rights management technology used with the Moment Care Service;
copy the content (except as expressly authorized by these terms of use); or
create derivative works from the Content
Restrictions on your use of Moment Care Services. You can’t and agree not to:
move, decompile, reverse engineer, disassemble or otherwise reduce the Moment Care service to a human-readable form;
modify, including but not limited to removing identification, copyright or other proprietary notices from the Moment Care content or service;
access or use the Moment Care Service in a manner that suggests an association with our products, services or brands;
create derivative works of the Moment Care service, any update or any part thereof;
bypass, modify, cancel, alter or circumvent any of the features or protections of the Moment Care Service, including, but not limited to, mechanisms that protect or restrict use of or access to the Service and Moment Care Content;
damage, disable, overload or alter the Moment Care service;
bundle the Moment Care Content or Service for redistribution with other products or services;
use the Moment Care Service in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms of Use.
The Moment Care service is developed by Moment Care and is designed to allow content to be viewed via compatible electronic devices. This software may vary depending on the device and support, and functionalities and features may also differ from one device to another. You agree to automatically receive updated versions of Moment Care software.
6-Personal data
Moment Care’s privacy policy explains how we handle your personal data and protect your privacy when you use our services. By using our Services, you agree that Moment Care may use this data in accordance with our Privacy Policy.
Users may exercise their rights of access, rectification, cancellation and opposition, or revoke the consent given to the aforementioned uses, by writing to Moment Care by e-mail at hello@Moment Care.tech or by post at 211, rue de l’université 75007 Paris, France.
7-Limited warranty
Moment Care undertakes to make every effort to ensure the availability and continuity of its Services and all related services. However, Moment Care cannot guarantee that these will function correctly at any Moment Care or that the User will be able to access and use them without delays, interruptions or errors. Similarly, Moment Care makes no warranty as to the suitability of the content included in its Services or of any of the associated products or services to meet the User’s specific needs.
Moment Care will act diligently in accordance with generally accepted industry practices to avoid the presence on its Services or any related services of viruses or other harmful elements that could cause alterations to the User’s computer system, documents or electronic files, but Moment Care cannot guarantee the absence of such elements and Moment Care will not be liable for any loss or damage they may cause.

8-Responsibility
Moment Care may, immediately and without obligation of prior notice, terminate and cancel its relationship with any given User, and cut off the User’s access to its Services, if it detects any Use that violates these Terms of Use or is otherwise fraudulent or non-compliant with applicable regulations and the User shall be liable for any loss and damage incurred directly or indirectly by Moment Care as a result of such Use and shall hold Moment Care harmless from and against any penalty, claims or lawsuits by any third party, including without limitation those initiated or imposed by public institutions, and in general, against any damages resulting – directly or indirectly – from the User’s breach of these Terms of Use.
9-Divisibility
If a court finds any provision of these Terms of Use to be unlawful, invalid or unenforceable, the remainder of its provisions shall continue in full force and effect and these Terms of Use shall be deemed amended to give effect to the deleted provision to the extent possible.
10-Applicable law and jurisdiction
These Terms of Use are governed by French law and any dispute arising from the performance or interpretation of these Terms of Use shall be submitted to the courts of the city of Paris (France).
